Who You Are Buying From
In The Dark Presents, located in Australia, acts as the promoter for the Event for which you purchase Tickets. We will be handling the transaction and collecting payment for the our events. All claims are the sole responsibility of In The Dark Presents.
If you did not buy your Ticket online from this website, not all of these Terms & Conditions are applicable. This generally applies to Tickets bought over the counter at Ticket Outlets and you may be subject to their Terms and Conditions.
Currency
All Ticket prices are shown in Australian Dollars.
Ticket License
Each Ticket that you purchase is a license to attend a particular Event and is subject to any additional terms and conditions set forth on that Ticket, on this website or from another company, individual or organisation that may be presenting or hosting the performance and the Ticket. Attendance of the Event and/or Venue is deemed to be acceptance of these Ticket Terms and Conditions.
Truthfulness and Accuracy of Information You Provide
You represent and warrant that all information you provide through this website will be true, complete and correct and that you will update all information as it changes.
Personal Information
You give consent to In The Dark to provide your applicable personal information to third parties used to process your Ticket purchase, delivery and attendance at an Event or Venue and the subsequent management of that personal information.
Order Confirmation
If you do not receive a confirmation reference (in the form of a confirmation page or email) immediately after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to contact In The Dark to confirm that your order has been placed. You may be the only person aware of any problems that may occur during the purchase process. In The Dark will not be responsible for losses (monetary or otherwise) if you assume that an order was placed when you failed to receive confirmation.
Billing Information Verification
Orders are usually processed only after billing information has been verified. When we receive incorrect billing or card information for a Ticket order, In The Dark will attempt to contact you using the information provided at the time of purchase. If In The Dark are unable to contact and communicate with you after the initial attempt, your order may be cancelled and the Tickets sold to another customer.
Processing and Delivery Fees
Tickets purchased on this website are subject to a non-refundable per Ticket booking fee or service fee and a non-refundable per order delivery fee.
Cancelled Events
Occasionally, Events are cancelled or postponed. When this occurs, In The Dark makes every effort to ensure you are advised and that you receive a prompt refund if applicable. If the Event was moved or rescheduled, In The Dark may set refund limitations.
Amended Events
Acts, Artists, Dancers, DJs, Guests, Performers, Speakers and Vocalists may sometimes be changed or cancelled by In The Dark at any time without notice.
Pricing and Other Errors
If the amount you pay for a Ticket is incorrect because of an error on this website or during processing, In The Dark will have the right to cancel that Ticket and refund the amount paid.
Venue Door List
In The Dark takes no responsibility for any unauthorised person that enters the Event or Venue under your name. Tickets cannot be replaced or payment refunded unless the Event Promoter agrees to reimburse In The Dark the full purchase price paid including any booking fee, service fee or delivery charge.
Duplicate Ticket Entry
In The Dark takes no responsibility for any unauthorised person that enters the Event or Venue using a copy of your Ticket. The unique 2D bar code printed on all Tickets will allow access only to the first Ticket used to enter the Venue. If your Ticket has been copied and used to enter the Event, it is your responsibility. Tickets cannot be replaced or payment refunded unless the Event Promoter agrees to reimburse In The Dark the full purchase price paid including any booking fee, service fee or delivery charge.
Venue Capacity
This is determined by those who are promoting or otherwise providing the Event for which you purchase a Ticket. You acknowledge that In The Dark is not responsible for any under or over capacity.
Venue Closure or Interruption
You acknowledge and agree not to hold In The Dark liable for any Venue closure or interruption during an Event.
Force Majeure
If the performance of any part of these Ticket Terms and Conditions is prevented, hindered, delayed or otherwise made impracticable by reason of an act of God, strike, lockout or other interference with work, war (declared or undeclared), blockade, disturbance, lightning, fire, earthquake, storm, flood, explosion, governmental or quasi governmental restraint, expropriation, prohibition, intervention, direction or embargo, unavailability or delay in availability of equipment or transport, inability or delay in obtaining governmental or quasi governmental approvals, consents, permits, licenses, authorities or allocations and any other cause, whether of the kind specifically enumerated above or otherwise which is not reasonably within the control of the Party affected or In The Dark, we shall be excused to the extent that it is prevented, hindered, or delayed by such causes.
Indemnity
You agree to be fully responsible for and fully indemnify us against all claims, liability, damages, losses, costs and expenses, including legal fees suffered by us and arising out of any breach of the Ticket Terms and Conditions by you.
Limitation of Liability
By purchasing a Ticket through In The Dark, you agree to these Ticket Terms and Conditions on behalf of yourself and any accompanying minor. You assume all risks incidental to the Event for which a Ticket is issued, whether before, during or after the Event.
Governing Law
The Ticket Terms and Conditions will be exclusively governed by and construed in accordance with the laws of New South Wales, Australia whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
General
If any part of the Ticket Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Ticket Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Ticket Terms and Conditions.
